1. Acceptance of Terms

By creating an account or using Audio Battles ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to use Audio Battles. By registering, you confirm that you meet this requirement.

3. Your Account

  • You are responsible for maintaining the confidentiality of your credentials.
  • You must provide accurate and truthful information when registering.
  • You may not create accounts on behalf of others without their consent.
  • One person may maintain only one account.
  • You are responsible for all activity that occurs under your account.

4. User Content

You retain ownership of the audio files, profile information, and other content ("User Content") you submit to the Platform. By submitting User Content, you grant Audio Battles a non-exclusive, worldwide, royalty-free licence to host, display, and stream your content solely to operate the Platform.

You represent and warrant that:

  • You own or have the necessary rights to submit the content.
  • The content does not infringe any third-party intellectual property, privacy, or other rights.
  • The content complies with these Terms and applicable law.

5. Prohibited Conduct

You agree not to:

  • Upload content that is illegal, defamatory, obscene, hateful, or that infringes third-party rights.
  • Harass, abuse, or harm other users.
  • Submit audio that you do not have the right to use.
  • Use automated scripts, bots, or other means to manipulate votes or platform metrics.
  • Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
  • Create multiple accounts to circumvent bans or restrictions.
  • Impersonate any person or entity.

6. Content Removal

We reserve the right to remove any User Content that violates these Terms, without prior notice. We are not obligated to monitor all content but may do so at our discretion.

7. Account Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your own account at any time via your Edit Profile page.

8. Battle Rules

  • Battle organisers are responsible for the battles they create and must comply with these Terms.
  • Participants must submit original audio within the deadlines set by the organiser.
  • Voting manipulation is prohibited and may result in disqualification and account suspension.
  • The Platform's automated ranking and bracket systems are final.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Audio Battles and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

11. Governing Law

These Terms are governed by the laws of Germany (Munich). Any disputes shall be resolved in the competent courts of that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on the Platform or by email. Continued use after changes constitutes acceptance.
